1. Agreement to Terms

By accessing or using easyfunnel.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

easyfunnel.ai is an AI-powered marketing automation platform that provides tools for:

• Performance tracking and analytics

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

4. Subscription Plans and Payment

4.1 Subscription Tiers

4.2 Billing

Paid subscriptions are billed in advance on a monthly basis. Payment is processed through our third-party payment processor, Stripe. You authorize us to charge your payment method on a recurring basis for your subscription fee.

4.3 Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No refunds will be provided for partial subscription periods.

4.4 Usage Limits

Each subscription tier includes monthly limits on creatives, images, videos, campaigns, and other resources. If you exceed your limits, you may be required to upgrade to a higher tier to continue using the Service.

5. Acceptable Use Policy

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service
• To generate content that is defamatory, obscene, pornographic, or otherwise objectionable
• To attempt to bypass usage limits or access features not included in your subscription tier

6. Intellectual Property Rights

6.1 Service Content

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of easyfunnel.ai and its licensors. The Service is protected by copyright, trademark, and other laws.

6.2 User-Generated Content

You retain all rights to the content you create using the Service, including creatives, campaigns, emails, and landing pages. However, by using the Service, you grant us a license to use your content for the purposes of providing and improving the Service.

6.3 AI-Generated Content

Content generated by our AI models is provided to you under a non-exclusive license. You are responsible for ensuring that any AI-generated content complies with applicable laws and third-party rights before use.

The Service integrates with third-party platforms including but not limited to:

• Facebook/Meta Ads
• Google Ads
• Shopify
• Klaviyo
• Stripe (for payments)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third parties.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FUNNEL AI MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Service will be accurate or reliable
• AI-generated content will be free from errors or suitable for your purposes
• Any defects in the Service will be corrected

9. Limitation of Liability

IN NO EVENT SHALL FUNNEL AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Performance of marketing campaigns created using the Service
• Errors or inaccuracies in AI-generated content

10. Indemnification

You agree to defend, indemnify, and hold harmless easyfunnel.ai and its licensors and licensees, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.

11. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
